What the board does
The Zoning Board of Adjustment is a quasi-judicial body created under Section 211.008 of the Texas Local Government Code. It hears:
- Variances from setback, height, lot size, parking and sign standards, when strict application of the ordinance would cause an unnecessary hardship that the owner did not create
- Appeals of decisions made by the Building Official or the Planning & Development Director
- Special exceptions the zoning ordinance allows the board to grant
At least four members must hear each case, and four must vote in favor to grant a variance. A variance cannot be granted only for financial reasons. The board’s decisions are final; an appeal goes to district court, not to City Council.
Past variances include V-2008-12, which allowed a dance floor narrower than the code requires, and V-2014-02, which allowed the 85-foot pole sign at MegaGrab Supercenter.
Requesting a hearing
The board meets only when a case is pending. File a variance or appeal application with Planning & Development at least 30 days before the hearing. Owners within 200 feet are notified by mail.
How to apply to serve
Members must live inside the city limits. Pick up an application form from the City Secretary at City Hall, 150 E Brisket St, or call (936) 555-0110. Return it in person or by mail to P.O. Box 1887, Dongvile, TX 76969. City Council makes regular appointments each September, and alternates are often appointed to regular seats as they open.
